RE: The tariff classification of a flashlight and a portable multifunctional lamp combined with radio from China.

Dear Ms. Peiffer:

In your letter dated May 4, 2006, on behalf of Griffin Marketing & Promotions, you requested a tariff classification ruling.

The subject merchandise, based on the submitted information, consists of the following:
a rechargeable, battery-operated LED flashlight, item number 507A, which is known as the Dynamo ECO LED Flashlight. This lamp has a hand crank to generate a specific amount of continuous illumination; an on/off button switch for activating the light; and a textile wrist strap affixed to the bottom of the lamp. It can also be charged by means of a 12V DC adapter and a 12V AC adapter (not included), in addition to being capable of accommodating a mobile phone charger (not included).
a multifunctional lamp with built-in radio, item number 503R.

The applicable subheading for the LED flashlight, item number 507A, will be 8513.10.2000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Portable electric lamps designed to function by their own source of energy.Lamps: Flashlights. The rate of duty will be 12.5 percent ad valorem.

Your inquiry does not provide enough information for us to give a classification ruling on the multifunctional lamp with radio, item number 503R. Your request for a classification ruling should include a sample (in its retail-packed condition if possible) of this product. When this information is available, you may wish to consider resubmission of your request. We are returning any related samples, exhibits, etc. If you decide to resubmit your request, please include all of the material that we have returned to you.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
