RE: The tariff classification of a scrub top from China.

Dear Mr. Houser:

In your letter dated April 24, 2006 you requested a classification ruling.

The drawing and information submitted is that of a scrub top, no style number, made of woven 65% polyester/35% cotton fabric. The short sleeve garment has a V neckline and two pockets below the waist.

The applicable subheading for the scrub shirt will be 6211.43.0060, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Track suitsother garments: Other garments, women’s or girls’: Of man-made fibers, Blousesexcluded from heading 6206.” The duty rate will be 16% ad valorem. The textile designation is 641.
