RE: The tariff classification of a Three-Tier Economy Cart from China.

Dear Mr. Crago:

In your letter dated April 21, 2006, on behalf of Corporate Express, you requested a tariff classification ruling.

The merchandise under consideration is identified as a Three-Tier Economy Cart, Item Number C097CA00026. The article is a floor standing rolling cart made of plastic (polypropylene) measuring 85 cm x 43 cm x 95 cm. It features four non-marking 4” swivel castors and three shelves, each with a ¼” lip on three sides and a flat fourth side for easy loading and unloading. You have submitted a photograph of the cart with your request.

The applicable subheading for the Three-Tier Economy Cart will be 9403.70.8030, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Other furniture and parts thereof: Furniture of plastics: Other, Other.” The rate of duty will be Free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
