RE: The tariff classification of pill holders from China

Dear Ms. Gauthier:

In your letter dated April 11, 2006, on behalf of CVS Pharmacy, you requested a tariff classification ruling.

The merchandise consists of three styles of pill holders. Item number 465500 is a nitroglycerine pill case. It is a small, cylindrical-shaped, nickel-plated brass container. Item number 341684 is a deluxe pill fob on a key ring. It is a small, round case made of nickel-plated brass with a removable cover. Attached to the cover is a steel split wire ring. The last item is number 341688, a deluxe nitro-fresh pill fob on a key ring. The case is made of rigid molded plastic with a removable lid. Attached to the lid is a steel split wire ring. All three pill containers are of a size suitable to be carried in a pocket or handbag.

The applicable subheading for the brass pill cases (item numbers 341684 and 465500) will be 7419.99.1500, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other articles of copper, other, other, containers of a kind normally carried on the person, in the pocket or in the handbag. The rate of duty will be 3 percent ad valorem.

The applicable subheading for the plastic pill case (item number 341688) will be 3926.90.9880, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other articles of plastics, other, other, other. The rate of duty will be 5.3 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
