RE: The tariff classification of printed advertising displays from Canada or China.

Dear Ms. Boullet:

In your letter dated February 22, 2006, you requested a tariff classification ruling. You submitted illustrations and descriptions pertaining to two products used for promotional purposes in retail stores.

The first item, identified as a “footwear riser” (BRN885), is a rectangular, box-like article, made of corrugated paperboard covered with printed paper, measuring 13” x 8” x 2 ½”(H). The printing on the top surface consists of an outdoor scene, while the printing on the sides consists of a brand name and logo for a line of footwear. The item is designed to be placed on a table or counter in a retail store, where it will serve as a platform upon which a shoe or boot will rest. Its primary purpose is to call attention to and promote the brand of footwear being displayed. You have advised that its design is such that it is not suitable for use as a container, and that it will function exclusively as an advertising riser.

The second item, ART667, is also a “footwear riser.” It is essentially the same as the above-described product, but exhibits different graphics, i.e., brand names/ logos on both the top and side panels, with no picture or scene.

The applicable subheading for the BRN885 and ART667 “footwear risers” will be 4911.10.0080, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other (than certain enumerated) printed trade advertising material. The rate of duty will be Free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
