RE: The tariff classification of stainless steel jewelry from Germany and Austria.

Dear Ms. Price:

In your letter dated January 26, 2006, you requested a tariff classification ruling.

The merchandise to be imported consists of European contemporary jewelry made of stainless steel. The jewelry items include rings, necklaces, bracelets, cufflinks and pendants. You have submitted photographs of representative samples with your request.

The applicable subheading for stainless steel jewelry other than cufflinks will be 7117.19.9000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Imitation jewelry: Of base metal, whether or not plated with precious metal: Other: Other: Other.” The rate of duty will be 11% ad valorem.

The applicable subheading for stainless steel cufflinks will be 7117.11.0000, HTSUS, which provides for “Imitation jewelry: Of base metal, whether or not plated with precious metal: Cuff links and studs.” The rate of duty will be 8% ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
