RE: The tariff classification of a rocking horse with sound from China

Dear Mr. Fung:

In your letter dated January 10, 2006, you requested a tariff classification ruling.

You are requesting the tariff classification on a product that is identified as a rocking horse with sound. The rocking horse is designed for riding, and both a galloping sound and a neighing sound are produced while the child is rocking on the horse. In addition, the mouth and tail move automatically while the toy horse is in motion. The rocking horse will be classified in Chapter 95 of the HTSUS as a toy that represents an animal. Pictures were submitted, in lieu of samples.

The applicable subheading for the rocking horse with sound (no style number indicated) will be 9503.49.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for toys representing animals or non-human creaturesand parts and accessories thereof: other. The rate of duty will be free.
