RE: The tariff classification of baby furniture from China.

Dear Mr. Olsen:

In your letter dated January 2, 2006, on behalf of Bellini Baby Furniture, you requested a tariff classification ruling.

The merchandise to be imported is identified as “Domani Group of Baby Furniture” consisting of baby furniture items made of wood, medium density fiberboard (MDF) and plywood as follows:
toy box crib
5 drawer unit changing table with unattached mirror chifferobe armoire

The applicable subheading for the crib will be 9403.50.9040, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Other furniture and parts thereof: Wooden furniture of a kind used in the bedroom: Other: Other, Beds.” The rate of duty will be Free.

The applicable subheading for the toy box, 5 drawer unit, changing table, chifferobe and armoire will be 9403.50.9080, HTSUS, which provides for “Other furniture and parts thereof: Wooden furniture of a kind used in the bedroom: Other: Other, Other.” The rate of duty will be Free.

The applicable subheading for the mirror will be 7009.92.5000, HTSUS, which provides for “Glass mirrors Other: Framed: Over 929 square centimeters in reflecting area." The rate of duty will be 5% ad valorem.

The toy box, 5 drawer unit, changing table, mirror, chifferobe and armoire may be subject to antidumping duties or countervailing duties. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
