RE: The tariff classification of a backpack and lanyard from China.

Dear Mr. Wilkinson:

In your letter dated December 15, 2005, on behalf of Kangourou Media, Inc., you requested a classification ruling for a backpack and lanyard.

You have submitted literature of two items with your request identified as style numbers BG-006 “Convertible Bag” and NG-007 “Neck Strap” (lanyard). The items consist of a backpack manufactured of nylon mesh textile material with a bottom panel that appears to be a woven fabric and a lanyard of nylon woven fabric. The lanyard features an easy clip-on hook with spring loaded swivel hook. It is assumed that the lanyard is imported with nothing attached to the clip.

The applicable subheading for the backpack will be 4202.92.3020, Harmonized Tariff Schedule of the United States (HTSUS), which provides for travel, sports and similar bags, with outer surface of textile materials, other, of man-made fibers, backpacks. The duty rate will be 17.6 percent ad valorem.

The applicable subheading for the lanyard will be 6307.90.9889, HTS, which provides for other made up articles of textile, other. The duty rate will be 7 percent ad valorem.

HTS 4202.92.3020 falls within textile category designation 670. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes.
