RE: The tariff classification of carded wool from New Zealand

Dear Mr. Bresnihan:

In your letter dated Dec. 14, 2005, you requested a tariff classification ruling. In your letter you describe wool as follows:

The wool is cleaned (scoured) through a two step process to ensure it is absolutely clean. Its brand name is “Sunrise” to differentiate it as a special bedding wool from wool that is used for carpet or rugs. It is of specially selected bulky wool fiber of between 33 and 34 micron. This wool is processed in New Zealand after scouring by a carding machine. These are machined into small wool balls of approximately 3/8” to 1/2” diameter.

The applicable subheading for the carded wool will be 5105.10.0000, Harmonized Tariff Schedule of the United States HTSUS, which provides for carded wool. The rate of duty will be 6.5 cents per kilogram plus 5.3% ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
