RE: The tariff classification of a disposable coverall from China.

Dear Mr. Flynn:

In your letter dated December 13, 2005 you requested a classification ruling.

Style 26 is a coverall composed of non-woven spun bounded polypropylene textile fabric. The picture you have submitted indicates that the garment is a coverall with an attached hood and boots, elasticized at the wrists and around the opening of the hood, tightening at the neck and a full front zipper closure. All features of the coverall are for use in contaminated areas.

The applicable subheading for the disposable coverall, style 26, will be 6210.10.5000, Harmonized Tariff Schedule of the United States (HTS), which provides for "Garments, made up of fabrics of heading 5602, 5603, 6903, 5906 or 5907: Of fabrics of heading 5602 or 5603: Other: Non-woven disposable apparel designed for use in hospitals, clinics, laboratories or contaminated areas." The rate of duty will be Free.
