RE: The tariff classification of “bittersweet chocolate baking stick” (product number CHD-BB-308BY-357 from France.

Dear Mr. Forbes:

In your letter dated November 23, 2006, on behalf of Barry Callebaut Canada, of Hyacinthe, Quebec, you requested a tariff classification ruling.

The subject merchandise is stated to contain 53.5 percent sugar, 43.5 percent cocoa paste, 2.0 percent cocoa butter, with soy lecithin and vanillin added as emulsifiers. The bittersweet chocolate baking sticks will be imported in rectangular packages of 1.60 kilograms. The product will be used in baking by bakeries and professional chefs.

The applicable subheading for the bittersweet chocolate baking sticks will be 1806.32.3000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Chocolate and other food preparations containing cocoa: Other, in blocks, slabs or bars: Not filled: Preparations consisting wholly of ground cocoa beans, with or without added cocoa fat, flavoring or emulsifying agents, and containing not more than 32 percent by weight of butterfat or other milk solids and not more than 60 percent by weight of sugar: Other: The rate of duty will be 4.3% ad valorem.
