RE: The tariff classification of television apparatus.

Dear Ms. Cumins:

In your letter dated November 8, 2006, on behalf of Sanyo Electronic Device (USA) Corporation, you requested a tariff classification ruling.

The item in question is an Out-of Band Tuner (OOB) denoted as models U2017AM and 115U2007AM-F. Each is designed solely or principally for use in digital or digital/analog television broadcast receivers.

Each is a printed circuit assembly that extracts certain digital data from incoming cable television transmissions. Although denoted as an Out-of-Band tuner they do not select a certain broadcast signal from a number of such signals within a particular frequency band. Each is incapable of “tuning” the television broadcast signal. Instead they extract other transmitted digital data and relay it for processing by other internal components of the television receiver. They also will extract data that the cable broadcaster may use to administer the broadcast system. The Out-of-Band device functions separately and differently than the broadcast tuner.

The applicable subheading for the Out-of-Band tuners, models specified above, will be 8529.90.0060, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Parts suitable for use solely or principally with the apparatus of headings 8525 to 8528: Other: Printed circuit assemblies: Of television apparatus: Printed circuit boards and ceramic substrates with components assembled thereon, for color television receivers; subassemblies containing one or more of such boards or substrates, except tuners or convergence assemblies: Other. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
