RE: The tariff classification of a man’s jacket from Indonesia

Dear Ms. Kim:

In your letter dated November 10, 2006, on behalf of Hojeon Limited, you requested a classification ruling.

The sample submitted, style number HJ1103, is a man’s hip-length baseball-style jacket. The entire two front panels of the jacket are constructed of a woven gun club check design 80% wool/20% nylon fabric. The rear panel and the sleeves are constructed of a woven 100% cotton canvas fabric. The jacket is lined with a woven man-made fiber fabric in the body and sleeves that is quilted in a diamond pattern to a nonwoven polyester batting insulation.

The jacket has a full front opening secured by a zipper closure that extends to the top of the collar, two front slash pockets at the waist and an inner pocket with a hook and loop closure. The jacket has a stand-up neck warmer collar composed of a ribbed-knit fabric, long sleeves with ribbed-knit fabric cuffs and a ribbed-knit fabric waistband. A cotton canvas fabric overlay appliqué that features the “Yankees” tradename is sewn across the front chest area.

The sample is being returned to you as you have requested.

In your letter you suggested classification for this garment under HTSUS 6201.92.20, which provides for men’s woven jackets of cotton. Because the entire front of this garment is comprised of the woven 80% wool/20% nylon fabric, the essential character of this garment is imparted by this fabric.

The applicable subheading for the jacket will be 6201.91.2011, Harmonized Tariff Schedule of the United States (HTSUS), which provides for anoraks (including ski-jackets), windbreakers and similar articles: Of wool or fine animal hair: Other: Men’s. The duty rate will be 49.7¢ kg + 19.7 percent ad valorem.

The jacket falls within textile category 434. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries.
