RE: The tariff classification of Quick Set 2 Kit from China.

Dear Mr. Wicher:

In your electronic ruling request dated October 27, 2006, you requested a tariff classification ruling on merchandise identified as Quick Set 2 Kit, item number 09943. This kit or set would be composed of three products that you currently import and enter as separate articles for tariff classification purposes.

The three articles currently imported individually include the model 00614 V-Pod, an item attached to the barrel of a gun for support; model 04109 Ground Blind, a hunting concealment; and, model 06821 Deluxe Ground Seat, an apparatus upon which a hunter would sit.

Classification of merchandise under the Harmonized Tariff Schedule of the United States (HTSUS) is governed by the General Rules of Interpretation (GRIs), taken in order.

Based on the information you have supplied, there is no specific heading in the tariff schedules that refers to your proposed Quick Set 2 Kit in its completed form even when considering GRI 3(b) which specifically refers to goods put up in sets. This office has concluded that the article under consideration is merely a group of separate components that will be packaged together as an accessory kit. We have determined that the components would continue to be separately classifiable and dutiable in accordance with GRI 1 of the HTSUS.

Accordingly, whether the three articles are imported separately or as goods put up in sets for retail sale, the articles will continue to be classified separately for tariff purposes. The applicable subheading for the model 00614 V-Pod will be 9305.29.5000, HTSUS, which provides for “Parts and accessories of articles of heading 9301 to 9304: Of shotguns or rifles of heading 9303: Other: Other.” The rate of duty will be free. Regarding the remaining two items, the Ground Blind and the Deluxe Ground Seat, only the first six digits of each subheading code you submit are correct. You will need to furnish explanatory information as to the construction and materials of these items before we can issue a ruling on the correct 10-digit Harmonized tariff subheading code applicable to each component.

Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
