RE: The tariff classification of a woman’s shirt from China

Dear Ms. Manguso:

In your letter dated November 6, 2006, you requested a classification ruling.

The submitted sample, style 18881, is a woman’s shirt constructed from 70 percent cotton and 30 percent polyester woven yarn dyed fabric. The shirt features long sleeves that are rolled up and fastened by a self-fabric tab, a banded collar, side vents and a full front opening secured by six buttons.

The applicable subheading for the shirt will be 6206.30.3011, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s or girls’ blouses, shirts and shirt-blouses: of cotton: other: other: other: with two or more colors in the warp and/or the filling: women’s. The duty rate will be 15.4 percent ad valorem.

Style 18881 falls within textile category 341. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
