RE: The tariff classification of an outdoor family game called “Top Toss” from China

Dear Ms. Aldinger:

In your letter dated October 18, 2006, you requested a tariff classification ruling.

You are requesting the tariff classification on a product that is described as “Top Toss”, an outdoor family game that is designated as style number 948443. The game includes the following components: a “Top Toss” tower, 6 bolo balls, a storage bag, and playing instructions. The objective of the game is to score points by hitting the tower so that the bolo balls wrap around the “Top Toss” tower. The sample will be returned, as requested by your office.

The applicable subheading for the “Top Toss” game, style 948443, will be 9506.99.6080, Harmonized Tariff Schedule of the United States (HTSUS), which provides for articles and equipment for general physical exercise, gymnastics, athletics, other sportsparts and accessories thereof: other: otherother. The rate of duty will be 4% ad valorem.
