RE: The tariff classification of women’s knit wearing apparel from China

Dear Ms. Lee:

In your letter dated October 20, 2006, requested a classification ruling. Your samples are being returned.

The submitted samples, styles D63855, D62671 and D63871, are women’s upper body garments. The outer surface of the fabrics measures more than 9 stitches but less than 18 stitches per 2 centimeters in the direction that the stitches were formed.

Style D63855 is a woman’s 100% cotton cardigan that features a round neckline, long sleeves with ribbed cuffs, a full front opening with a woven placket that has 9 button closures, and a ribbed bottom. Decorative beads adorn the placket area. The garment does not meet the requirements of Statistical Note 6, Chapter 61, Harmonized Tariff Schedule of the United States (HTSUS) because of the woven placket.

Style D62671 is a woman’s 100% cotton cardigan that features a round neckline, long sleeves with ribbed cuffs, a full front opening with 9 button closures, a ribbed ruffled placket constructed from knit cotton fabric and woven silk fabric, and a ribbed bottom. This garment does not meet the requirements of Statistical Note 6, Chapter 61, HTSUS, because of the woven fabric on the left placket of the left panel.

Style D63871 is a woman’s 100% cashmere sleeveless pullover that features tie shoulder closures, a round neckline, side slits, and a rolled bottom.

The applicable subheading for styles D63855 and D62671 will be 6110.20.2079, HTSUS, which provides for sweatersand similar articles, knitted: of cotton: otherother: women’s. The duty rate will be 16.5% ad valorem.

The applicable subheading for style D63871 will be 6110.12.1060, HTSUS, which provides for pullovers, knitted: of wool or fine animal hair: of Kashmir (cashmere) goats: wholly of cashmere: other: women’s. The duty rate will be 4% ad valorem.

Styles D63855 and D62671 fall within textile category 339. Style D63871 falls in category 446.
