RE: The tariff classification of a wireless remote freezer monitor from China

Dear Mr. Miller:

In your letter dated October 12, 2006 you requested a tariff classification ruling.

The item in question is the Kenmore Freezer-Mate Monitor (Model #9000). It’s a portable, wireless remote monitor that uses an LCD screen to display the status of a designated Kenmore Elite Freezer. When placed up to 100 feet from the freezer, this monitor will display current freezer temperature and alert you both visually and audibly to certain freezer conditions. An alarm will sound when the temperature inside the freezer rises above a certain level and the LCD display will alternate between the current temperature and the duration of the condition. There are also alarms and various icon-displays that activate if the freezer door is ajar, if there is a loss of signal strength or power or if the battery life is running low.

This product does not contain a thermometer or any type of temperature controlling mechanism. The thermometer-sending unit is built into certain freezer models. The sending unit transmits information to the Kenmore Freezer-Mate Monitor (Model #9000), which uses it’s LCD screen for display purposes only.

The applicable subheading for the Kenmore Freezer-Mate Monitor (Model #9000) will be 8531.20.0020, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Electric sound or visual signaling apparatus : Indicator panels incorporating liquid crystal devices (LCD’s) : Incorporating LCD’s”. The rate of duty will be Free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
