RE: The tariff classification of tile covers from China

Dear Ms. Ramsey:

In your letter dated October 10, 2006, you requested a tariff classification ruling.

The sample you submitted is described as “Set/10 ‘Rooster’ Wall Tile Covers,” item number 57800. The package includes ten base metal squares, each decorated with a rooster design, and double-sided tape to facilitate mounting. Each tile measures approximately 4-1/2 inches square. Your letter indicates that they are made of tin, however, since they attract a magnet, we presume them to be made of steel. As per the documentation you provided, these tile covers are used to decorate plain, discolored or damaged tiles.

The applicable subheading for the base metal tile covers will be 8306.29.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for bells, gongs and the like, nonelectric, of base metalstatuettes and other ornaments, and parts thereof, other. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
