RE: The tariff classification of work and uniform pants from Sri Lanka.

Dear Mr. Nolan:

In your letter dated October 24, 2006, on behalf of Industrial Textiles Ltd., you requested a tariff classification ruling.

You have submitted three samples. Style 501 “Work Pant” is a pair of men's woven pants constructed of 65% polyester fiber and 35% cotton fabric. The garment features two side pockets, a zippered fly-front with a button closure, a partially elasticized waist, belt loops and overstitched bottoms.

Style 501E “Baggy Pant” is a pair of men's woven pants constructed of 65% polyester fiber and 35% cotton fabric. The garment features two side pockets, one back patch pocket, an internal drawstring, an elasticized waist and hemmed bottoms.

Style 9022 “Chef Pant” is a pair of men's woven pants constructed of 65% polyester fiber and 35% cotton fabric. The garment features two side pockets, two back pockets, a zippered fly-front with a button closure, belt loops and overstitched bottoms

The applicable subheading for styles 501, 501 E and 9022 will be 6203.43.4010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for man’s or boys’ suits, ensembles, suit-type jackets, blazers, trousers, bib and brace overalls, breeches and shorts: of synthetic fibers: other: other: other: other, trousers and breeches: men’s. The rate of duty will be 27.9 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
