RE: The tariff classification of a pullover for boys’ wear from Mexico

Dear Mr. Venable:

In your letter dated October 20, 2006 you requested a classification ruling.

Submitted style UOY2, manufactured from finely knitted fabric of either 100% cotton or of 90% cotton/10% polyester, is a round-necked garment, the long sleeves of which are loosely fitted.

As you have requested, the sample garment is being returned.

The applicable subheading for this style will be 6110.20.2069, Harmonized Tariff Schedule of the United States (HTSUS), which provides for pulloversand similar articles, knitted, of cotton, other, other, other, boys’, other. The duty rate will be 16.5 per cent ad valorem.

This garment falls within textile category 338. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries.
