RE: The tariff classification of two women’s knit garments from Jordan.

Dear Ms. Purcell:

In your letter dated October 23, 2006, you requested a classification ruling for two garments. The samples will be returned, as requested.

Style A6705 consists of two garments, a cardigan and pants, constructed from 65 percent polyester, 35 percent cotton pique fleece knit fabric with more than nine stitches per two centimeters in the direction the stitches were formed. The cardigan has a hood, a full front opening with a zipper closure, long raglan sleeves with rib knit cuffs, side seam pockets, and a loose fitting rib knit bottom. The pull-on pants have an elasticized waistband and hemmed legs. The garments are in contrasting colors.

The applicable subheading for the cardigan of style A6705 will be 6110.30.3059, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Sweatersand similar articles, knitted or crocheted: Of man-made fibers: Other: Women’s or girls’: Other. The duty rate will be 32 percent ad valorem.

The applicable subheading for the pants of style A6705 will be 6104.63.2011, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Women’strousersknitted or crocheted: Of synthetic fibers. The duty rate will be 28.2 percent ad valorem.

The cardigan of style A6705 falls within textile category designation 639; the pants of style A6705 fall within textile category designation 648. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries.
