RE: The tariff classification a woman’s knit garment from China.

Dear Mr. Schoenig:

In your letter dated October 2, 2006, you requested a tariff classification ruling for a woman’s knit garment on behalf of Regatta (U.S.A.), L.L.C. The submitted style will be returned to you as requested.

The submitted item, style DFRG2132, is a woman’s pullover constructed from 60 percent rayon, 40 percent cotton knit fabric. The pullover garment has a cowl neckline, long sleeves, and a rib knit bottom. The cowl neckline extends to the rib knit portion of the garment, so that the garment does not provide coverage of the bust.

The applicable subheading for style DFRG2132 will be 6114.30.3070, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Other garments, knitted or crocheted: Of man-made fibers: Other: Women’s or girls’. The rate of duty will be 14.9 percent ad valorem.

Style DFRG2132 falls within textile category 659. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries.
