RE: The tariff classification of a women’s wearing apparel from China

Dear Mr. Smith:

In your letter dated October 4, 2006, you requested a classification ruling. The submitted sample will be returned to you as requested.

Style A6549 consists of a woman’s jacket, blouse and pullover. The jacket is constructed from 96 percent cotton and 4 percent spandex woven fabric. The jacket features long sleeves with buttoned cuffs, a collar, two chest pockets with buttoned flaps, two on seam front pockets at the waist, a full front opening secured by six buttons and adjustable back tabs at the bottom. The blouse is constructed from 100 percent cotton woven fabric and features long sleeves with buttoned cuffs, a collar, side vents and a full front opening secured by seven buttons. The pullover is constructed from 95 percent cotton and 5 percent spandex knit fabric. The pullover features a scooped neckline, ¾ length sleeves and a hemmed bottom. The outer surface of the garment measures more than 9 stitches per 2 centimeters in the horizontal direction.

The applicable subheading for the jacket will be 6204.32.2030, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s or girls’ suits, ensembles, suit-type jackets, blazers, dresses, skirts, divided skirts, trousers, bib and brace overalls, breeches and shorts (other than swimwear): suit-type jackets and blazers: of cotton: other: other: women’s. The duty rate will be 9.4 percent ad valorem.

The applicable subheading for the blouse will be 6206.30.3041, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s or girls’ blouses, shirts and shirt-blouses: of cotton: other: other: other: other: women’s. The duty rate will be 15.4 percent ad valorem.

The applicable subheading for the pullover will be 6110.20.2079, Harmonized Tariff Schedule of United States (HTSUS), which provides for sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of cotton: other: other” women’s or girls’: other. The duty rate will be 16.5 percent ad valorem.

The jacket falls within textile category 335; the blouse falls within textile category designation 341 and the pullover falls within textile category designation 339. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
