RE: The tariff classification of a travel bag from China or Taiwan

Dear Ms. Tolchin:

In your letter dated September 20, 2006, you requested a tariff classification ruling on behalf of your client, ShadowBag Industries, of Greenville, North Carolina.

The submitted sample is identified as “ShadowBag.” The item is a travel bag constructed with an outer surface of man-made textile material. It is designed to provide storage, protection, organization, and portability to accessories associated with a military uniform and well as other personal effects. It features numerous interior pockets, a hanging hook, and an adjustable closure.

The applicable subheading for the travel bag will be 4202.92.3031, Harmonized Tariff Schedule of the United States (HTSUS), which provides for travel, sports, and similar bags, with outer surface of textile materials, other, of man-made fibers, other. The rate of duty will be 17.6% ad valorem.

HTSUS 4202.92.3031 falls within textile category designation 670. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
