RE: The tariff classification of photoluminescent sheet from Japan

Dear Ms. Dyer:

In your letter dated September 22, 2006, on behalf of Izumi America, Inc., you requested a tariff classification ruling.

The photoluminescent sheet consists of a top layer of polyurethane resin containing photoluminescent pigment and a bottom layer of polyester film. You indicated in a telephone conversation that the weight of the polyurethane layer exceeds the weight of the polyester layer. The sheet will be imported on rolls, in dimensions of 40 inches in width and 300 meters in length.

The applicable subheading for the photoluminescent sheet will be 3920.99.2000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other plates, sheets, film, foil and strip, of plastics, noncellular and not reinforced, laminated, supported or similarly combined with other materials: of other plastics: film, strip and sheets, all the foregoing which are flexible: other. The rate of duty will be 4.2 percent ad valorem.

In your request you have asked whether this product is subject to antidumping (AD) duties. Written decisions regarding the scope of AD/CVD orders are issued by the Import Administration in the Department of Commerce and are separate from tariff classification and origin rulings issued by Customs.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
