RE: The tariff classification of iPod covers from China

In your letter dated September 15, 2006, you requested a tariff classification ruling. Your sample is being returned to you, as requested.

The submitted samples are iPod covers identified as style #GG9294. They are constructed of a knit textile material that you state is 50% acrylic/50% cotton. The iPod covers measure approximately 2”(W) x 4”(H). It is designed to provide storage, protection, organization and portability to an iPod device.

You have indicated in your letter that the fabric that this item is constructed from is a blend of 50% cotton/50% acrylic. Items claimed to be constructed from such a blend are subject, upon importation, to laboratory analysis by U.S. Customs and Border Protection to verify the actual weight of the component fibers. Please be advised that a slight variation from the above stated fiber content may affect the classification and the textile category designation of the subject item.

The applicable subheading for the carry bags will be 4202.92.9026, Harmonized Tariff Schedule of the United States (HTSUS), which provides in part, for other bags and containers, with outer surface of textile materials, other, other, of man-made fibers. The duty rate will be 17.6% ad valorem.

HTSUS 4202.92.9026 falls within textile category designation 670. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise, which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information on quota and visa requirements applicable to this merchandise, we suggest you check, close to the time of shipment, the "Textile Status Report for Absolute Quotas" which is available on our web site at www.cbp.gov. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
