RE: The tariff classification of a woman’s skirt from China.

Dear Ms. Parker:

In your letter dated September 27, 2006, you requested a classification ruling. The provided samples will be returned as per your request.

Style 357489 is a woman’s skirt constructed of a 55% linen, 45% cotton woven fabric. The skirt has an elasticized waistband with a drawstring and a plain, hemmed bottom.

The applicable subheading for the skirt will be 6204.59.4060, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Women’s or girls’skirts: Of other textile materials. The rate of duty will be 6.6% ad valorem.

Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/.

The skirt falls within textile category 842. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
