RE: The tariff classification of a men’s knit jacket from China.

Dear Mr. Liu:

In your letter dated September 20, 2006, you requested a tariff classification ruling on behalf of K.J. Sportswear. As requested, your sample will be returned.

Style “Billabong Men’s Black Knitted Fleece Sport Jacket MSN6ROB” is a men’s jacket constructed from 80% cotton, 20% polyester, finely knit fabric that is napped on the inside surface. The garment features a self-fabric hood with a drawstring, a full front opening with a zippered closure, long sleeves with rib knit cuffs, pouch pockets below the waist, and a rib knit bottom. There is a large appliqué with embroidery on the center chest and a flocked logo on the left sleeve.

The applicable subheading for Style “Billabong Men’s Black Knitted Fleece Sport Jacket MSN6ROB” will be 6101.20.0010, Harmonized Tariff Schedule of the United States, (HTSUS), which provides for: men’s or boys’ overcoats, carcoats, capes, cloaks, anoraks (including ski-jackets), windbreakers, and similar articles, knitted or crocheted: other than those of heading 6103: of cotton: men’s. The rate of duty is 15.9% valorem.

Style “Billabong Men’s Black Knitted Fleece Sport Jacket MSN6ROB” falls within textile category designation 334.
