RE: The tariff classification of a men’s jacket from China

Dear Ms. Boullet:

In your letter dated September 15, 2006, you requested a classification ruling. A sample was submitted and is being returned as you requested.

The item in question, style HM7062, is a men’s jacket made from a combination of 100% nylon oxford fabric with a visible polyurethane coating on the inner surface and 100% polyester knit fleece fabric. The chest portions consist of woven oxford on the exterior quilted to the knit polyester. The upper back, the entire sleeves (with the exception of a small triangular-shaped piece at the wrist) and the lower front portions that comprise over-sized pockets have woven fabric on the exterior and knit fabric backing. The lower back is knit fabric only. The jacket has a full front opening with a zipper extending to the top of the collar, long sleeves with tabs secured by hook and loop closures, slant pockets at the waist and an elasticized drawstring through the bottom hem.

According to your letter the manufacturing process consists of cutting all fabric to shape, sewing the woven and knit pieces together (including quilting), then sewing the parts together into a finished garment.

The applicable subheading for the jacket will be 6210.40.5020, Harmonized Tariff Schedule of the United States (HTSUS), which provides for garments, made up of fabrics of heading 5602, 5603, 5903, 5906 or 5907: other men’s or boys’ garments: of man-made fibers: anoraks (including ski-jackets), windbreakers and similar articles. The duty rate will be 7.1 percent ad valorem.

This jacket falls within textile category 634. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
