RE: The tariff classification of a costume from Taiwan.

Dear Mr. Fragomeli:

In your letter dated September 8, 2006, you requested a classification ruling. As requested, the sample will be returned to you.

Your submitted sample, Item Number 6891025 (size medium) is a girl’s Renaissance Princess Costume. The well-made costume consists of a dress constructed of knit polyester fabric. The dress has styling features, a well-made neck, waist, seams and finished arm, closure, vest and bottom hem edges. You will be importing the identical costume in Item Numbers 6891024 (size small), 6891026 (size large), the only difference is the size range.

The applicable subheading for Item Numbers 6891025, 6891024 and 6891026 will be 6104.43.2020, Harmonized Tariff Schedule of the United States (HTSUS), which provides for provides for women’s or girls’ suits, ensembles, suit-type jackets, blazers, dresses, . . . knitted or crocheted: dresses: of synthetic fibers: other, girls’. The duty rate will be 16 percent ad valorem.

All Item Numbers fall within textile category designation 636. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
