RE: The tariff classification of a cell phone holder from China

Dear Ms. Trotta:

In your letter dated September 12, 2006, you requested a tariff classification ruling.

The submitted sample is a cell phone holder constructed from man-made textile fabric. It measures approximately 2.75” (W) x 5” (H) and features a decorative textile flower sewn on the front, flower charms, and a shoulder strap.

The applicable subheading for the cell phone holder will be 4202.92.9026, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other containers and cases, other, with outer surface of textile materials, of man-made fibers. The rate of duty will be 17.6% ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).

HTSUS 4202.92.9026 falls within textile category designation 670. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
