RE: The tariff classification of a pet dog costume, from China.

Dear Ms. Fragomeli:

In your letter dated September 11, 2006, you requested a tariff classification ruling.

You submitted a representative sample of style 6809910 (BIKER DOG). The costume is largely of knit polyester man-made fiber construction which has been coated with a plastics material on one surface. It is of two pieces, a hat to be placed over the dog’s head and the remaining portion to be secured over the torso area of the dog. The name in brackets above depicts the particular theme of the respective costume.

The applicable subheading for the costume will be 4201.00.6000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for saddlery and harness for any animal (including traces, leads, knee pads, muzzles, saddle bags, dog coats and the like), of any material: other. The rate of duty will be 2.8 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
