RE: The tariff classification of a cardigan for girls’ wear from China

Dear Mr. VerPault:

In your letter dated September 13, 2006 you requested a classification ruling.

Submitted style 10213TDS7, manufactured from jersey fabric of 98% cotton/2% rayon that measures 10 stitches per 2 centimeters, is an ornamented garment, characterized by long sleeves, a full-front opening, and a buttoned closure below the round neckline. All of the components of this garment are knit to shape and assembled by linking and looping.

The submitted garment and its accompanying component parts are being retained by this office for reference purposes.

The applicable subheading for this style will be 6110.20.2077, Harmonized Tariff Schedule of the United States (HTSUS), which provides for sweatersand similar articles, knitted, of cotton, other, other, other, girls’, knit to shape articles described in statistical note 6 to this chapter. The duty rate will be 16.5 per cent ad valorem.

This style falls within textile category 339.
