RE: The tariff classification of a men’s knit pullover garment from Guatemala.

Dear Mr. Scharpf:

In your letter dated September 22, 2006, you requested a tariff classification ruling. As requested, your sample will be returned.

Style 50226 is a men’s pullover garment constructed from 80% cotton, 20% polyester, double knit fabric that measures 14 stitches per 2 centimeters counted in the horizontal direction. Style 50226 is cut and sewn and features a crew neckline; long, hemmed sleeves; and a straight, hemmed bottom.

The applicable subheading for Style 50226 will be 6110.20.2069, Harmonized Tariff Schedule of the United States, (HTSUS), which provides for: sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of cotton: other: other: other: other: men's or boys'. The duty rate is 16.5% ad valorem.

Style 50226 falls within textile category 338.
