RE: The tariff classification of lighted Christmas trees from China.

Dear Ms. Balog:

In your letter dated September 26, 2006, on behalf of your client Sienna LLC, you requested a tariff classification ruling.

The submitted photographs depict two lighted Christmas trees. One artificial tree is fashioned with a pole in the middle designed to stand on the floor. The spiraling lights around the pole give the appearance of a lighted Christmas tree with a star on the top. The other tree is designed to stand on the floor. The lights extending from the star to the floor give the appearance of a lighted Christmas tree with a star on the top.

The applicable subheading for the lighted Christmas trees will be 9505.10.2500, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Festive...articles for Christmas festivities and parts and accessories thereof: Christmas ornaments: Other: Other. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
