RE: The tariff classification of women’s maternity tops from India

Dear Ms. Caliari:

In your letter dated September 22, 2006, you requested a classification ruling. The submitted sample will be returned to you as requested.

Style 10627 is a woman’s maternity blouse constructed from 100 percent cotton woven fabric. The blouse features short sleeves, a mock wrap front, an empire waist and a back zipper closure. The lower portion of the blouse in lined. The blouse has rows of contrasting colored stitching around the neckline and sleeve edges.

Style 10640 is a woman’s maternity pullover constructed from 100 percent viscose knit fabric. The garment is sleeveless and features a mock wrap front, a V-neckline, an empire waist and a ruffled bottom. The outer surface of the garments measures more than 9 stitches per 2 centimeters in the horizontal direction.

The applicable subheading for style 10627 will be 6206.30.3041, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s or girls’ blouses, shirts and shirt-blouses: of cotton: other: other: other: women’s. The duty rate will be 15.9 percent ad valorem.

The applicable subheading for style 10640 will be 6110.30.3059, Harmonized Tariff Schedule of the United States (HTSUS), which provides for sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of man-made fibers: other: other: other: other: women’s or girls’: other. The duty rate will be 32 percent ad valorem.

Style 10627 falls within textile category 341 and style 10640 falls within textile category designation 639. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries.
