RE: The tariff classification of a woman’s blouse from China

Dear Ms. Fox:

In your letter dated September 13, 2006, you requested a classification ruling on behalf of Sugartown Worldwide, Inc. The submitted sample will be returned to you as requested.

Style 65203 is a woman’s blouse constructed from 67 percent cotton and 33 percent silk woven fabric. The tank-styled blouse features a front and back V-neckline, an empire waist, a side zipper closure and measures 1-1/2 inches wide at the shoulder seams.

The applicable subheading for the blouse will be 6211.42.0056, Harmonized Tariff Schedule of the United States (HTSUS), which provides for track suits, ski-suits and swimwear; other garments: other garments, women’s or girls’: of cotton: blouses, shirts and shirt-blouses, sleeveless tank styles and similar upper body garments excluded from heading 6206: other. The duty rate will be 8.1 percent ad valorem.

Style 65203 falls within textile category 341. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
