RE: The tariff classification of a ”Zip Hoody” for girls’ wear from China

Dear Ms. Teague:

In your letter dated September 14, 20006, written on behalf of Quality Worldwide, Inc., you requested a classification ruling.

Submitted style 6456 Pac Sun YC, manufactured from fleece fabric of 100% cotton, is characterized by a rib-knitted waistband and cuffs of long sleeves, by a full-front, metal zipper, by an open pocket at the lower portion of each of the fronts, and by a hood through which an adjustable drawstring is threaded.

As you have requested, the submitted sample is being returned.

The applicable subheading for this garment will be 6102.20.0020, Harmonized Tariff Schedule of the United States (HTSUS), which provides for girls’windbreakers and similar articles, knitted, other than those of heading 6104, of cotton, girls’. The duty rate will be 15.9 per cent ad valorem.

The garment falls within textile category 335. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries.
