RE: The tariff classification of a decorative glass article from China

Dear Ms. Powell:

In your letter dated August 29, 2006, you requested a tariff classification ruling. A representative sample was submitted with your ruling request.

The product in question, designated in your letter as article catalogue number 070332, is a set consisting of a globe-shaped glass bowl painted yellow and a yellow cradle-shaped ceramic (dolomite) holder/base. The glass bowl is designed to be placed into the ceramic holder. The glass bowl measures approximately 4 inches in diameter by 2 ¼ inches in diameter at the top opening by 4 ½ inches in height. The ceramic holder measures approximately 4 inches in length by 3 inches in height at each end. According to the brochure that was submitted with your letter, the item will be imported in three colors.

You stated in your letter that the glass bowl and ceramic holder will be packed together for retail sale in their imported condition. You further stated that this article will be principally used in florists’ arrangements.

The essential character of this article is imparted by the glass bowl.

You indicated in your letter that the unit value of this item is over thirty cents but not over $3.00.

The applicable subheading for the glass bowl with ceramic holder will be 7013.99.5000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for glassware of a kind used for table, kitchen, toilet, office, indoor decoration or similar purposesother glassware: other: other: other: valued over $0.30 but not over $3.00. The rate of duty will be 30 percent ad valorem.
