RE: The tariff classification of a woman’s garment from China

Dear Ms. Teague:

In your letter dated September 8, 2006, you requested a classification ruling on behalf of Quality Worldwide, Inc. As requested, your sample is being returned to you.

In your letter, you describe Style ZGPF121E12 as a woman’s jacket constructed from 80% Cotton and 20% Polyester. The cut and sewn garment is of finely knit fleece like sweatshirt material napped on the interior of the garment. It features a full front opening with a zippered closure, a hood, two front pockets, long sleeves with rib cuffs and thumb hole and a rib knit bottom.

The applicable subheading for style ZGPF121E12 will be 6102.20.0010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s or girls’ overcoats, carcoats, capes, cloaks, anoraks (including ski jackets) windbreakers and similar articles, knitted or crocheted, other than those of heading 6104: Of cotton. The duty rate will be 15.9% ad valorem.

Tariff number 6102.20.0010 falls within textile category 335. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
