RE: The tariff classification of a girl’s cropped garment from China or Macau

Dear Mr. Fung:

In your letter dated September 7, 2006 you requested a classification ruling.

Submitted style SK-904 is a girl’s cropped hooded article that is made of french terry knit fabric that is 65 % polyester, 35% cotton. It features a full front zipper opening; long sleeves, a hood and rib knit fabric at the sleeve cuffs and garment bottom. The item does not reach the vicinity of the waist. Style SK-904 is sized for girls 7-16.

The sample garment will be returned to you as requested.

Although you requested classification as an outerwear jacket or a pullover, this is not possible because of the abbreviated garment coverage.

The applicable subheading for style SK-904 will be 6114.30.1020, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other garments, knitted or crocheted, of man-made fibers, tops, women’s or girls’. The duty rate will be 28.2 per cent ad valorem.

Style SK-117 falls within textile category designation 639. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes.
