RE: The tariff classification of a boy’s knit vest from China

Dear Mr. Maher:

In your letter dated August 30, 2006, on behalf of your client The Children’s Place Ser Com LLC, you requested a classification ruling.

Submitted style E2612L0012 is a boy’s vest manufactured from cotton knit jersey fabric containing approximately 10 stitches per 2 centimeters measured in the direction the fabric is formed. The pullover garment has a vee neck opening and rib knit fabric at the neckline, armhole openings and waistband. While you propose classification in a Chapter 61, Statistical Note 6 provision for knit to shape articles, this is not possible because the garment being a vest, other than a sweater vest, is not classifiable in such a provision.

As you have requested, the sample garment and its accompanying component parts are being returned.

The applicable subheading for style E2612L0012 will be 6110.20.2030, Harmonized Tariff Schedule of the United States (HTSUS), which provides for cotton vests, other than sweater vests, knitted or crocheted, men’s or boys’. The duty rate will be 16.5 per cent ad valorem.
