RE: The tariff classification of a woman’s coat from China

Dear Mr. Renaut:

In your letter dated August 29, 2006, on behalf of Shihreen, Inc., you requested a classification ruling.

The sample submitted, style number B0347, is a woman’s coat constructed of a shell that is composed of a woven velvet 75% rayon/25% silk fabric with a flower and leaf design. The coat is lined with a woven polyester fabric.

The coat extends to the knee area in length, is fitted at the waist, has a notched lapel-style collar and a full front opening that is secured by a right-over-left, seven button closure. The garment has long sleeves that have a v-shape hemmed edge at the wrist area that can be folded-over and worn as a cuff, two front patch pockets below the waist and a straight hemmed bottom.

You indicated that the base fabric is entirely rayon, while the velvet pile portion is entirely silk. In accordance with HTSUS Section XI Subheading Note 2(B)(b) only the pile portion is to be considered in determining the classification. Therefore, the applicable subheading for the coat will be 6202.19.1000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other: women’s overcoats, carcoats: capes, cloaks and similar coats: of other textile fibers: containing 70% or more by weight of silk or silk waste. The duty rate will be Free.

The coat falls within textile category 735. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
