RE: The tariff classification of a woman’s jacket from China

Dear Mr. Lam:

In your letter dated August 28, 2006, on behalf of Mary Mac Apparel Inc., you requested a classification ruling. Your sample is being returned.

The submitted sample, style number 757-3255, is a woman’s jacket that is constructed from 100% cotton knit fabric with a knit lining. The jacket features a hood, a V-neck, long hemmed sleeves with ribbed cuffs, a full front opening with a zipper closure, 2 front pockets at the waist, and a ribbed bottom.

The applicable subheading for the jacket will be 6102.20.0010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s overcoatswindbreakers and similar articles, knitted other than those of heading 6104: of cotton: women’s. The duty rate will be 15.9% ad valorem.

The jacket falls within textile category 335. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
