RE: The tariff classification of women’s dresses from China

Dear Ms. Tsoi:

In your letter dated August 22, 2006, you requested a classification ruling.

The submitted sample, style 385X412 is a sleeveless women’s dress made from crocheted and woven fabric. The crocheted fabric is 55% linen and 45% cotton and comprises the straps, bust and upper back of the garment. The 100% printed woven cotton fabric comprises the remainder of the garment. The pullover garment extends to approximately the calf area and features U-shaped front and rear necklines. The woven fabric imparts the essential character to the garment.

The applicable subheading for style 385X412 will be 6204.42.3050, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s dresses: of cotton: other: other, other: other women’s. The duty rate will be 8.4 percent ad valorem.

Style 385X412 falls within textile category 336. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
