RE: The tariff classification of a decorative ceramic flowerpot from China

Dear Ms. Powell:

In your letter dated August 10, 2006, you requested a tariff classification ruling. A representative sample was submitted with your ruling request.

The subject article, identified in your letter as article catalogue number 070330, is a coral-colored ceramic (non-porcelain) flowerpot with two sticks of chalk. The flowerpot is square-shaped with rounded corners and has an attached saucer. The flowerpot measures approximately five inches in height by four and one half inches square at the top opening by four inches square at the base.

You stated in your letter that the flowerpot will be imported with two sticks of chalk. The ultimate customer will use the chalk to design the outside of the flowerpot. You further stated that this article will be principally used in florists’ arrangements.

The applicable subheading for the ceramic flowerpot with chalk will be 6913.90.5000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for statuettes and other ornamental ceramic articles: other: other: other. The rate of duty will be 6 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
