RE: The tariff classification of four nonwoven “Surface Veil Fabrics”, which have application as surface coverings in various industrial applications, from either Taiwan or China.

Dear Mr. McCullough:

In your letter dated August 15, 2006, which was a follow-up to an earlier inquiry where we requested additional information, you requested a tariff classification ruling. This letter is on behalf of International Outsourcing Inc., Cheshire, CT.

Four representative samples were submitted which were identified as styles 358A, 358B, 026A and 026B, respectively. All four materials are of nonwoven construction, are composed of 100 percent polyester man-made fibers (filament), and weigh between 30 – 45 g/m². These four fabrics will be imported as roll goods to be used in certain industrial applications. One application that you specifically mention, is that the materials will be cut to shape and size and placed on the rails of ladders, which will lend support to the surface and finish of such ladders.

The applicable subheading for the four materials will be 5603.12.0090, Harmonized Tariff Schedule of the United States (HTSUS), which provides for nonwovens, whether or not impregnated, coated, covered or laminated, of man-made filaments, weighing more than 25 g/m² but not more than 70 g/m². The rate of duty is Free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
