RE: The tariff classification of a boy’s knit garment from China

Dear Mr. Maher:

In your letter dated August 14, 2006, on behalf of your client The Children’s Place Ser Com LLC, you requested a classification ruling.

Submitted style E2612L0017 is a boy’s polo style shirt manufactured from cotton knit jersey fabric containing approximately 14 stitches per 2 centimeters measured in the direction the fabric is formed. The garment has a three-button opening at the neckline that fastens left over right; a shirt collar, short sleeves and rib knit fabric at the sleeves and waistband.

All of the components of this garment are knit to shape and assembled by linking and looping. The garment qualifies as knit to shape in accordance with Chapter 61, Statistical Note 6.

As you have requested, the sample garment and its accompanying component parts are being returned.

The applicable subheading for style E2612L0017 will be 6110.20.2067, Harmonized Tariff Schedule of the United States (HTSUS), which provides for pullovers and similar articles, knitted or crocheted, of cotton, other, other, other, men’s or boys’, knit to shape articles described in statistical note 6 to this chapter. The duty rate will be 16.5 per cent ad valorem.
